The Immigration Laws in India are determined by the Indian government, and they differ depending on the type of foreign nationals. Generally, foreign nationals must obtain a valid visa prior to entering India.

Indian Visas:

Depending on the purpose of travel, visas can be obtained from the Indian Embassy or High Commission in a foreign national’s home country. The types of visas available in India include tourist visas, business visas, student visas, and employment visas. In addition, some foreign nationals may be eligible to obtain an Overseas Citizen of India (OCI) card. This card allows foreign nationals to stay in India for an extended period of time, but it does not provide them with the same rights and privileges as Indian citizens.

Immigration Department (BOI):

Immigration department in India (BOI) was setup in the year, 1971 by Government of India to undertake Immigration function in the country. Department is headed by Commissioner of Immigration and assisted by FRROs for immigration facilitation service at airports and work relating to registration of foreigners under various Acts and Rules.

Functions of BOI:

The main functions of BOI are:

  • To facilitate the entry and exit of foreigners from India.
  • To monitor the stay of foreigners in India and to ensure that they comply with the relevant provisions of the Foreigners Act, 1946 and the Registration of Foreigners Rules, 1992.
  • To issue visas, permits, residence or other documents for the entry, stay or departure of foreigners in India.
  • To register foreigners and issue registration certificates to them.
  • To investigate any violation of the Foreigners Act and the Registration of Foreigners Rules, 1992.
  • To provide immigration facilitation services at airports and other ports of entry into India.
  • To provide information relating to immigration matters to citizens of India and foreigners.
  • To interact and coordinate with other government agencies, foreign missions, airlines and other stakeholders on immigration related matters.

   It is pertinent to note that, there are 12 Foreign Regional Registration Offices in major cities i.e. Mumbai, Delhi, Kolkata, Chennai, Amritsar, Bengaluru, Hyderabad, Calicut, Kochi, Trivandrum, Lucknow and Ahmedabad.

There are 12 Chief Immigration Officers in the cities i.e. Goa, Jaipur, Gaya, Varanasi, Nagpur, Pune, Mangalore, Trichy, Coimbatore, Bagdogra, Chandigarh and Guwahati. At remaining places District Superintendent of Police (SP) or the prescribed authority functions as FRO to facilitate foreigners.

Modernization Program:

To strengthen the Immigration system, a modernization programs viz. Mission Mode Project on Immigration, Visa Foreigners’ Registration and Tracking (IVFRT) has been undertaken by Bureau, with the assistance of National Informatics Center (NIC).

The objective of this project is to facilitate efficient border management, to strengthen the identity management system, to improve security and to prevent illegal migration. The project seeks to develop a centralized system for biometric registration and tracking of foreign nationals. It will capture biometric data and store it in a database. This information can be used to detect fraudulent identities, to track and manage visitor information, to identify and manage security threats, and to facilitate the grant of visas and other immigration services.

   In addition to this, the project also seeks to modernize the existing immigration system by introducing online applications, automated document verification and an online visa processing system. This would allow for quicker processing of applications and reduce the time and effort required for processing.

Also, the project aims to strengthen the security of the Immigration system by introducing multi-factor authentication, facial recognition and advanced biometric scanning techniques. This will help in detecting fraudulent identities and preventing illegal immigration. The project also seeks to develop a secure, efficient and cost-effective way to manage and track the movement of foreign nationals. This would help in ensuring that foreign nationals are not overstaying their visas and are complying with the laws of the country. Finally, the project seeks to provide an effective system for monitoring and managing immigration-related services. This would allow for better service delivery and improved customer satisfaction.
